The present general conditions of sale apply to any order placed by a consumer, within the meaning of the european Directive n° 2011/83/EU of 25 October 2011, in respect of the Products offered for sale on the Site (hereinafter, the " Site ") by :

The present general conditions of sale apply to all orders placed on the Internet site

LEBAGACIER is a merchant website dedicated to professionals only which will be identified prior to any transaction via the application of the access code on the site.

LEBAGACIER reserves the right to validate or not any request for the creation of a customer account at the time of registration if it deems it necessary and regardless of the reason, without any justification.

LEBAGACIER reserves the right to cancel any order if it deems it necessary and regardless of the reason, without any justification.

LEBAGACIER reserves the right to adapt or modify at any time the present general conditions of sale.

In case of modification, it will be applied to each order the general conditions of sale in force at the date of the order.

Article 2 : Products and availability

Products " means articles sold on the Site by LEBAGACIER.

The Products offered on the Site are described and presented with the greatest possible accuracy.

The offers of Products are proposed subject to availability.

LEBAGACIER will make its best efforts to update its inventory and, in case of unavailability of a Product, remove it from the Website. When a size of a Product is not available, the check box in the Product data sheet will not be selected.

LEBAGACIER reserves in any case the right to withdraw at any time any Product of the Site and/or to replace or adapt or modify any content or information on the Product listed on the Site.

The Products remain the property of LEBAGACIER until full payment of the price.

Article 3 : order Validation and electronic signature (act of 13 march 2000 on electronic signature)

Any purchase order signed by the consumer "click" is an irrevocable acceptance which can be questioned only in the limits foreseen in the present general conditions of sale.

The "click" associated with the authentication and non-repudiation and integrity protection of messages constitutes an electronic signature. This electronic signature has value between the parties in the same manner as a handwritten signature.

The minimum order is 150 € H. T.

Article 4 : Price

LEBAGACIER reserves the right to modify its prices at any time but undertakes to apply the rates current which will have been indicated at the time of your order.

LEBAGACIER reserves the right to refuse any order whose amount would be less than € 150 HT.

Article 5 : Payment

LEBAGACIER lets you choose between 4 ways of payment for your order :

  • Payment by credit card (Sogecommerce - Société Générale)

For maximum safety, we chose to use Sogecommerce as secure payment solution. This system is developed by the Company in General. Security is via encryption technology TLS (Transport Layer Security), solution of the latest generation, which is currently the most reliable available for payments on the internet. The blue cards Visa, Visa Electron, E-carte bleue, Mastercard and Maestro are accepted as well as payment by the system Paylib.

Sogecommerce, the secure payment solution of the Société Générale group is certified PCI DSS (Payment Card Industry Data Security Standard). The PCI DSS standard is adopted by the network, Mastercard, and Visa to strengthen the safety relating to the use and storage of the data of the card holders. It is a global standard also supported by other networks such as American Express JCB and Diners.

3D Secure protocol : customer Identification.
To greatly reduce fraud on the internet, increase the trust in the payment by card and consolidate the dynamics of electronic commerce, the French banks, have agreed to adopt a new regulation on the credit card payments on the internet. This regulation is based on the protocol "3D Secure" developed by the 2 international networks of cards, Visa and Mastercard (name Verified by Visa and Mastercard Secure code).

This protocol has been established on the payment platform Sogecommerce for several years. In the framework of this protocol, it is now up to the customer's bank to verify the identity of the bearer of this card when it settles on the platform of secure payment Sogecommerce. This control is performed by the customer's bank, directly on the internet with a method of its own (code, secret, personal and confidential information, the case of reading-to-chip,...).

  • Payment with PayPal (PayPal account optional)

The secure payment solution "PayPal Integral Evolution" offer you 2 possibilities :

1 - If you have an account with PayPal, you simply, at the time of payment, to identify you simply and totally secure.

2 - If you do not have an account PayPal you can pay your order directly with your standard debit and credit card (Visa, MasterCard, American Express, Discover, etc..).

  • Payment by cheque

We only accept bank checks or postal checks from a banking institution established in France.

Your order will be processed upon receipt of your payment.
You have a period of 7 days to make the shipment of your cheque, beyond this period your order will automatically be cancelled.
An email will be sent upon receipt of your payment and your cheque will be cashed immediately.

  • Payment by bank transfer

In choosing the mode of payment by bank transfer payment information, you will be notified automatically.

You have a period of 7 days to make the transfer on our account indicated above, beyond this period your order will automatically be cancelled.

Default of Payment
LEBAGACIER reserves the right to refuse a delivery or honour an order from a customer who would not have regulated completely or partially a preceding order or with whom a payment dispute is being of directors.

Article 6 : Modalities of delivery in Metropolitan France, Corsica and Monaco

6.1 – delivery methods and costs

The products are delivered to the delivery address that you indicated during the order process. The transfer of risk to the buyer is effective upon the release of the goods of our stores and depots.

The delivery is free of charge if your order is greater than or equal to 300 € H. T. (valid for a single invoice maintained in case of a remainder subject to a number of deliveries).

Backorders not shipped in a first time due to out of stock will be the subject of a subsequent delivery free of charge.

Below 300 € H. T., a participation fee of 10.00 € H. T. for the shipping charges you will be charged.

In all cases the minimum order is 150 € H. T.

6.2 - Time shipping

Thanks to our organization and to our system of logistics, we treat your order as fast as possible (under 48 hours max.).

Attention, all orders placed after Friday 13: 00 will not be sent until Monday of the following week. If a delay is likely to intervene in the delivery, LEBAGACIER will notify you asap.

All times announced are calculated in working days.

6.3 - delivery Time

Receive your order in 24h (working days) after the dispatch of your parcel (Metropolitan France, Corsica & Monaco).

We prefer to send by dhl to ensure a quick and safe delivery.

In all cases a tracking number is sent to you by e-mail once the package is shipped so you can track its delivery. This parcel number is also permanently available in your customer account.

The package is delivered against signature. In case of absence, the deliveryman will contact you by phone communicated at the time of the order. In case of unavailability, the parcel is deposited in the office of the nearest Post. You have 15 days to retrieve the parcel. If you do not collect the parcel within the 15 days, the parcel is automatically returned.

If at the time of delivery, the original packaging is damaged, torn, opened, you must then check the condition of the items. If they have been damaged, you must refuse the package and note a reserve on the delivery (parcel refused because opened or damaged).

6.4 – Returns

You will be able to exchange or get a full refund on products that have damages or defects, or if the products that you receive are not those that you had requested.

The deadline for any return is of 15 days once the items have been received.

Returns for damage or defect are free of charge.

THE BAGACIER reserves the right to reject returns communicated or sent outside the deadline, or if the products are not in the same conditions as when they were received.

6.5 - Treatment package : unclaimed / refused

If your package is returned by the carrier for the following reason :

- Package unclaimed during its period of instance

- Packages refused by the recipient at time of delivery

After receiving the package, we will refund you either by cheque or by wire transfer the amount originally debited, less the amount of the expenses of sending and return of goods (including, in the case where you have benefited from franco during the shipment of such goods.

Article 7 : Responsibilities

LEBAGACIER cannot be held responsible for the inexecution of the contract concluded, due to the occurrence of an event of force majeure and in particular in case of total or partial strike of carriers, and disasters caused by floods or fires. LEBAGACIER not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, damages or costs, problems related to the security of online payments, which could occur.

The choice and purchase of a product or a service are under the sole responsibility of the customer. The total or partial impossibility of using products notably because of incompatibility of material can give place to no compensation, refunding or blamed of the responsibility of LEBAGACIER, except in the case of a hidden defect found, non-conformity, defect or exercise the right of withdrawal.

In the case of non-delivery of an order or part order, you have a maximum of six months (from the date of departure from our warehouse) to manifest to you. Beyond this period, we will not accept any claim.

In this respect, and in accordance with the provisions of the Code of Intellectual Property, any use, total or partial reproduction or public dissemination of such information and documents is strictly prohibited, without the prior permission of LEBAGACIER.

Conversely, LEBAGACIER respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your jewel, accessory, or trade-mark has been used without authorization, or that your intellectual property rights have been violated please, please, contact LEBAGACIER with the following information :
